Right of Withdrawal and Model Form

1. When the right applies

A consumer who concludes a distance or off-premises contract with a trader generally has a statutory withdrawal period without giving a reason. For ordinary internet contracts the period is generally 14 days. The right normally does not apply to a transaction solely between private individuals, although the private seller may offer a voluntary return policy.

2. When the period begins

For services, the period generally begins when the contract is concluded. For a single item of goods it generally begins when the consumer or nominated third party receives it; special rules apply to multiple deliveries, batches and regular delivery. Failure to provide required withdrawal information may extend the period under applicable law.

3. How to withdraw

The consumer may use the model form, the online route where available, or any unequivocal statement sent to the trader before the deadline. The consumer should retain proof of submission. If Findit is not the trader, submission to Findit will be forwarded or routed, but consumers should also notify the identified trader when reasonably possible.

4. Services started during the period

A trader may begin a paid service during the withdrawal period only after obtaining the legally required express request and information on consequences. If the consumer later withdraws, a proportionate amount may be payable for the part properly performed. Full performance may end the right only where all statutory conditions, consent and acknowledgement requirements are satisfied.

5. Digital content and digital services

Supplying non-tangible digital content before the period ends may require prior express consent, acknowledgement of loss of the right and contractual confirmation. A pre-ticked or bundled statement is insufficient. Digital services, recurring access and mixed contracts must be classified and disclosed correctly before checkout.

6. Common statutory exceptions

Exceptions may cover custom-made goods, sealed hygiene or health-protection goods after unsealing, rapidly perishable goods, certain dated leisure events and specified accommodation, catering, transport or car-rental services. An exception is used only where its legal facts are met and the consumer received the required information.

7. Effects and reimbursement

Following a valid withdrawal, the trader must reimburse payments, including the legally required standard delivery amount, within the applicable period and may withhold a goods refund until return or proof of dispatch where permitted. Reimbursement should use the original method unless the consumer agrees otherwise and incurs no fee.

8. Returning goods and diminished value

The consumer must return goods within the statutory period and normally bears direct return cost only if properly informed. The consumer may inspect goods as in a physical shop but may be responsible for diminished value caused by handling beyond what is necessary to establish nature, characteristics and functioning.

9. Conformity rights remain separate

Withdrawal is not the same as a complaint about defects or lack of conformity. If the withdrawal period has expired or an exception applies, the consumer may still have repair, replacement, price reduction, termination, guarantee or damages rights against the contractual supplier.

10. Model withdrawal statement

To the contractual trader identified in the Listing or order: I/We give notice that I/We withdraw from the contract for the following goods or service: [description]. Ordered or contracted on: [date]. Received on, if goods: [date]. Consumer name and address: [details]. Order reference: [reference]. Date: [date]. Signature is required only for a paper form.

11. Contact and records

Findit support is available at hello@finditeu.com. The Platform may retain the withdrawal notice, time sent, supplier routing, acknowledgement and refund status to establish compliance and resolve disputes under the Privacy Policy.

12. Failure to provide withdrawal information

For a Polish consumer contract, if the trader did not provide the legally required information about the right of withdrawal, the consumer may exercise the right during the additional 12-month period provided by the Polish Consumer Rights Act. If the trader supplies the missing information during that extension, the applicable withdrawal period runs from receipt of that information; current Polish guidance states a 30-day period in that circumstance. The transaction record must preserve the information and durable-medium confirmation actually delivered.

Sending an unequivocal withdrawal statement before the applicable deadline is sufficient even if it arrives later.
